Alestetics GmbH – General Terms and Conditions for Cosmetic Treatments (GTC)
Scope
The present general terms and conditions (hereinafter referred to as GTC) govern the relationship between alestetics GmbH (hereinafter referred to as "alestetics") and the customers (hereinafter referred to as "customer").
Cosmetic service
alestetics provides non-invasive cosmetic treatments as a service. The duration of the treatment depends on the agreements in each individual case. The treatment time begins at the agreed time. An extension of the booked treatment is only possible spontaneously if other appointments are not affected.
Appointment
Appointment bookings are binding. If the customer is unable to attend an appointment, please cancel by telephone or in writing at least 24 hours in advance. Over the weekend, the cancellation period is 42 hours. If the cancellation is late or not made in time, the booked treatment will be charged.
Prices
The offers of alestetics GmbH are non-binding and subject to price changes. Unless otherwise agreed, the prices current on our homepage at the time of treatment apply.
Payment
The treatment costs are to be paid immediately after completion of the treatment. Subscriptions and vouchers are to be paid after completion of the first treatment. You have the option of paying in cash, with Post-Debit or credit cards or TWINT.
Liability
The customer must notify us of obvious treatment defects in writing within 3 calendar days of discovering the defect. Otherwise, warranty rights are excluded. Further warranties and guarantees, also with regard to compatibility and success of treatment methods and products used, are not given.
The liability of alestetics is limited to gross negligence and intentional acts. The above limitations of liability do not apply in the event of culpable injury to life, limb and health, and for the quality of the product and in the event of fraudulently concealed defects. In the event of a breach of essential contractual obligations, any claims for damages shall be limited to typical and foreseeable damage. Liability under the Product Liability Act remains unaffected.
Claims for damages against alestetics expire three months after the contractually agreed end of the treatment, provided that the claims are not asserted within this period.
alestetics cannot be held liable for damages caused by incorrect information and/or omission of essential information by the customer.
Vouchers
Vouchers can only be used to pay for treatments that are offered at the time of redemption and during opening hours.
Our offered vouchers for treatments are valid according to their defined term. The voucher must be redeemed within the voucher validity period. No extension is possible after this period. The vouchers expire at the latest 12 months after their issue unless otherwise stated.
Cash payment, including for residual amounts, is not possible if the voucher value exceeds the amount to be paid, nor is it possible to exchange the vouchers for merchandise vouchers in the online shop.
The vouchers are personal and non-transferable. The voucher will not be replaced if lost or stolen.
Subscriptions
Subscriptions can only be used for the specified services / treatments. They cannot be offset against other services / treatments. Subscriptions are personal and non-transferable. Subscriptions expire no later than 12 months after issue. Refunds for paid subscriptions are not possible.
Data Protection
Your personal data will always be treated confidentially and used and processed exclusively within the framework of the applicable data protection laws.
The customer agrees that their personal data may be used for advertising for their own and third-party purposes (e.g. delivery of a customer newsletter and participation in their own prize draws). The customer can prohibit the processing of their personal data at any time without stating reasons and revoke the consent given for the future.
Self-Pay Services
All alestetics services are excluded from cost sharing by health insurance companies. All services are self-pay services.
Final Provisions, Place of Jurisdiction and Applicable Law
Should a provision be or become invalid, this shall not affect the validity of any other provisions or agreements.
The court in Zurich has jurisdiction for disputes. Swiss law applies.
These terms and conditions are valid from 01.09.2021
